| IRISH FREEDOM COMMITTEE® NEWSLIST www.irishfreedomcommittee.net ----------------------------- Subject: Statement: “Lack of facilities a cause for grave concern” Date: Friday March 12, 2004 In a statement released yesterday from Belfast, prisoners' welfare spokespersons MARIAN PRICE and MARTIN MULHOLLAND said; "Following the move of republican prisoners from temporary accommodation to permanent segregated accommodation in Maghaberry Gaol, a number of issues have arisen and must be addressed immediately. The move to the segregated accommodation is in line with the Steele report into the segregation of political prisoners whereby prisoners from similar political backgrounds, and those who have been charged or convicted of political offences, are segregated in separate accommodation from criminals and loyalist prisoners. "The move took place last Sunday and immediately set the tone for what the men fear will be the regime in the future. Since entering the wing the men have been subjected to almost total lock down by prison officers. The policy of strict controlled movement allows only two men on the landing at any one time and is open to abuse by prison officers who wish to go slow. Added to this is the fact that the remand prisoners and sentenced prisoners are being separated from each other which means that each set of prisoners only get out to association every other night. As of yet there are absolutely no provisions for education on the wing. "Prisoners, if and when they have managed to get to association have found that there are absolutely no facilities for them, not even tables or chairs. The exercise yard is extremely small and is only separated from the loyalist yard by eight feet of wire mesh and the men have already suffered severe sectarian abuse because of this. None of the prisoners have had hot meals in the last three days and the vast majority of them have been unable to have a shower for the same period, those that have been able to get to the showers have reported the unhygienic state of them and have asked for them to be properly cleaned and maintained before they will use them. "Another sinister development has taken place in the new accommodation; the republican prisoners have been told they will no longer be able to look after the housekeeping on their wing as is standard practice, but all orderlies’ posts will be given to criminals from another house. The implications from this are extremely serious, given the fact that the majority of loyalists have refused segregation; there is no telling who could be coming onto the wing or indeed what they are bringing on with them. It is a matter of record that in the past loyalists and criminals have been able to bring in weapons and drugs to the prison, this is a matter of some concern to all republicans. Despite the fact that the prison service have been telling anyone that will listen that no expense has been spared in the new wings this is obviously not the case, indeed the only expense that hasn’t been spared is on security equipment with the prisoners likening the wing to camp x-ray. There is no part of the landings that is not covered by intrusive camera and microphone technology. "It is (our belief) that the prisoners are being made to pay for the fact that the British government deemed it necessary to introduce segregated accommodation, we urge the relevant authorities to move to put in place a humane regime for the prisoners immediately before the prisoners take matters into their own hands. | IRISH FREEDOM COMMITTEE® NEWSLIST ----------------------------- Subject: Seamus Doherty - Appeal from his family Date: March 5, 2004 An appeal from the family of Seamus Doherty, who is being held at Maghaberry Gaol on charges resulting from TAMPERED FORENSIC EVIDENCE.
In Sept 2002 the PSNI stopped two cars near a checkpoint in Newry, the second car was found to contain explosives, three people were arrested. The PSNI later charged two of these as being in a scout (the first) car and possessing explosives, the third person was released. After months in prison the forensic files became available and they made very interesting reading. An envelope not intended to be seen by the defence revealed that the man released had in fact been in the bomb car and had been covered in semtex explosives, his clothes, hands and even under his fingernails. It also revealed that an army unit opened sealed forensic bags and rubbed a gloved hand over the clothing of one of the two men charged. The programme basically revealed three main issues: - When the defence team stumbled across these criminal acts and applied for an ‘Abuse of Process,’ the DPP dropped all charges against the two men in Nov’2003 but offered the court no legal explanation. Imprisoned for thirteen months by the hands of a paid informer/agent, police and DPP obstructing and perverting justice and an army unit planting traces of explosives, the stench of the RUC/FRU is as strong as ever. Lets be clear, had the above information not accidentally come to light these two men would have been imprisoned for 20 years or more. As bad as that sounds, it gets worse, a Derry man Seamus Doherty is now spending his 9th month in prison charged with possessing the same explosives! He was arrested in June 2003, a whole nine months after the discovery in Newry, the PSNI claiming to have found his DNA on the explosives. He has always maintained his innocence and the fact that the evidence against him was planted; his solicitor Paddy Mac Dermott is fighting a legal battle to get his client released immediately. Not everything was disclosed by the Insight team, here now is a deeper look at the criminality of the PSNI/FRU in this case. It is alleged that two traces of DNA were found on the explosives – one too small for analysis the other was a possible match for DNA which resembles that of Seamus Doherty. Three points, if the informer/agent has semtex under his fingernails the only clear and obvious inferences that can be drawn are: - He was working with the device and was the actual the bomb maker - He must have left very high levels of his own DNA (working with his bare hands, didn’t wear gloves) - And thirdly what was his role that night as a paid informer/agent, was it to plant evidence? He now lives in an army barracks in England so we may never find out, however, if he didn’t leave DNA, fingerprints etc, then nobody else could have did either! In April 2003 a very odd search team of the PSNI/FRU paid a visit to Seamus’s apartment, (the significance only now becoming clear), the caretaker allowed them into the building and accompanied them to Seamus’s door but maintains they had their own key to his door. When he heard a key being turned Seamus went to the door and was confronted by three members of the PSNI/FRU, he was pushed and forced into his living room by one of them as the other 2 ran upstairs. He quickly realised something was wrong when the PSNI/FRU made a very clumsy attempt to justify their presence, so he forced his way out onto the landing of the flats to call for help from his neighbours. Immediately this PSNI/FRU shouted to his cohorts upstairs, “Wrong flat, lets go, lets go!” and they proceeded to run from the building. This is now highly significant for these reasons: - Despite him, the caretaker and a neighbour making statements to his solicitor at the time, who then wrote to the PSNI seeking an explanation, to date, nearly a year on, none has being received from the Strand Rd PSNI - The easiest method to obtain someone’s DNA is their bed, comb, toothbrush etc, all of which were available upstairs in his flat – Finally and crucially, a letter dated a day before the illegal search in April 2003, from the forensic lab in England to the forensic lab in Carrickfergus, stated, that DNA was found on the explosives but couldn’t be identified! A handwritten note attached to it by a Detective Allen states “Maybe more work as to be done”? – The PSNI/FRU were upstairs in Seamus’s apartment less than 24 hours later without explanation! This whole case reeks with criminals, criminals in police and army uniforms, free to flout the law, the courts and all sense of justice. This case highlights the depths to which the state can stoop to imprison innocent people. Its not about one over zealous cop, examine the facts – firstly, at what level or chain of command can someone pick up the phone and arrange an army unit to enter a police station unchallenged, open sealed forensic bags, leave traces of semtex on the clothing of an innocent person and all within a matter of hours? Obviously only a very senior member of the PSNI who feels immune from prosecution could make that call to a very secretive army unit who also feels immune! RUC had in glove with FRU! Is this army unit available 24 7? Was this the same unit who entered Seamus’s apartment dressed as PSNI? If they are quite content to plant evidence, conceal evidence and invent evidence they must surely have the full support of the DPP. This case highlights that the criminality exists at all levels because despite all of the above being made available to the DPP, they are still pushing for a conviction against Seamus. It seems that any sense of justice and what they may refer to as impartial integrity goes out the window when faced with the criminal PSNI/FRU bandwagon! Once again this so called new beginning to policing is laid bare, the core, base and backbone of the PSNI are the same criminals of the RUC. We now call on all those who advocate this new beginning, newspapers like the Derry Journal and Irish News to look into this case and the criminal actions of those involved and we call for the immediate release of Seamus and indeed ALL other prisoners arrested on bogus charges! Newry and Mourne Council are to discuss the Insight programme and the repercussions that it raises and we call on Derry City Council to do the same. We call also for all those who demand justice to take this case up at all levels and at every opportunity. Emails purporting to be from a variety of IFC addresses, including from this NewsList, were sent to an unknown number of persons by an individual in the UK using the server BlueYonder. The UK server has been alerted and is performing a trace. Please note that the IFC NewsList DOES NOT AT ANY TIME ever send attachments with emails. If you have received an email purporting to be from the Irish Freedom Committee that contains a zip file attachment, or any other attachment, we strongly encourage you to immediately delete it.
